Terms of Service
1. Acceptance of Terms
By downloading, installing, or using Calofit ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
You must be at least 13 years of age to use Calofit. By using the App, you represent that you are at least 13 years old.
2. Description of Service
Calofit is a nutrition and wellness tracking application. Features include:
- Food logging (AI-powered camera/barcode scanning and manual entry)
- Macro tracking (calories, protein, carbohydrates, fat)
- Food quality scoring (CQS)
- Water, steps, weight, and exercise tracking
- Meditation and fasting timers
- AI-powered weekly and monthly insights
The Service requires an iOS 26+ device.
3. Account Registration & Security
- You may create an account using Apple Sign-In or Google Sign-In.
- You are responsible for maintaining the security of your account.
- One account per person.
- You agree to provide accurate information.
4. Subscription Terms
4.1 Pricing
Subscriptions are managed through Apple:
- Monthly: $9.99/month
- Yearly: $69.99/year (3-day free trial)
4.2 Auto-Renewal
Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
4.3 Cancellation
To cancel your subscription: Settings > [Your Name] > Subscriptions > Calofit > Cancel. Cancellation is as simple as sign-up — via App Store Settings.
4.4 Refunds
Refunds are processed per Apple's refund policy.
5. Health & Medical Disclaimer
Additionally:
- AI-powered food recognition provides estimates, not exact values.
- Barcode data sourced from manufacturer labels (may contain errors).
- Calofit is NOT a medical device and is not FDA-approved.
- Not intended to diagnose, treat, cure, or prevent any disease.
6. AI Processing Disclosure
- Calofit uses third-party AI services to analyze food photos and estimate nutrition.
- Food photos are sent to AI for processing and not retained by the AI provider.
- AI results are suggestions only — users can review, edit, or reject all estimates.
- Users can opt out of AI by using manual food entry.
- AI does not make autonomous decisions affecting your account or health recommendations.
7. User-Generated Content
Community Foods: Users can contribute food entries to a shared database.
- Contributions are moderated for quality and accuracy.
- Content must be food/nutrition-related; no offensive, misleading, or harmful content.
- Users can report inappropriate community food entries via the in-app mechanism or by emailing help@calofit.app.
- We reserve the right to remove content and block users who violate these guidelines.
- By contributing, you grant Calofit a perpetual, royalty-free license to use, display, and distribute the contribution.
- You retain ownership of your contributed data.

8. User Conduct
You agree NOT to:
- Use the app for any unlawful purpose.
- Submit false, misleading, or harmful nutritional data to the community database.
- Attempt to access other users' data.
- Reverse-engineer, decompile, or disassemble the app.
- Use automated tools to scrape or extract data.
- Interfere with app infrastructure or security.
- Share your account credentials.
- Use the app if under 13 years old.
9. Intellectual Property
- Calofit, its logo, and associated branding are trademarks of Montane LLC.
- The app, including UI design, code, and proprietary algorithms (food quality scoring, wellness score), are protected by copyright.
- Food database may include data from OpenFoodFacts (Open Database License) and user contributions.
- You may not reproduce, distribute, or create derivative works without permission.
10. Account Deletion
- Available in-app: Account > Delete Account.
- Deletes: authentication, all personal data, all synced data, all stored photos, Apple Sign-In token revocation.
- Community food contributions are de-identified but remain in shared database.
- Deletion is permanent and irreversible.
- Processed within 30 days.
11. Limitation of Liability
The App is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for:
- AI estimation inaccuracies
- Data loss
- Service interruptions
- Health outcomes from app use
- Third-party service failures
Maximum liability is limited to the amount paid for your subscription in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold harmless Montane LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.
13. Dispute Resolution & Arbitration
13.1 Informal Resolution
Contact help@calofit.app. We require a 30-day good-faith negotiation period before formal proceedings.
13.2 Binding Arbitration
Disputes not resolved informally shall be resolved via binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules.
13.3 No Class Actions
You waive the right to participate in class-action lawsuits or class-wide arbitration.
13.4 Small Claims Exception
Either party may bring individual claims in small claims court.
13.5 Opt-Out
You may opt out of arbitration within 30 days of first use by emailing help@calofit.app.
14. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. The Federal Arbitration Act governs the arbitration provision.
15. Modifications to Terms
- We may modify these Terms at any time.
- Material changes will be notified 30 days in advance via email and/or in-app notification.
- Continued use after the effective date constitutes acceptance.
- If you disagree with changes, discontinue use and delete your account.
16. Modifications to Service
- We may modify, suspend, or discontinue features with reasonable notice.
- We are not liable for service modifications.
- Paid features affected by changes may qualify for pro-rata refund.
17. Severability & Entire Agreement
- If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and Montane LLC.
- No waiver of any provision constitutes a continuing waiver.
